TERMS OF USE

These Terms govern use of the FM Season Hub program and of the plugins distributed with it, and constitute an agreement between the User and the Operator. Signifying acceptance within the program or its Installer denotes full agreement with the provisions set out below. Absent such agreement, use of the program is not authorised.

1. Definitions

• Operator — FM Season Hub, an independent project established in Brazil, holder of the rights in the program.
• User — the natural person who installs and uses the program.
• Program — the FM Season Hub application, in any version.
• Installer — the wizard that installs, updates and removes the Program and, where chosen by the User, the Plugins.
• Plugins — the optional add-ons for the Game distributed by the Operator through the Installer, which run inside the Game during matches.
• BepInEx — the third-party open-source component that allows the Game to load the Plugins.
• Game — the title Football Manager, owned by a third party.
• Access key — the personal code that enables an access level.
• FM Season Hub Service — the remote service operated by the Operator that confirms the access level, publishes announcements and distributes the Program's updates.

2. Subject matter

The Program reads the Game's statistics while the Game is running on the User's device and stores them in a local database, for the purposes of consultation and comparison between seasons.

The Plugins, whose installation is optional, add features to the Game during matches, as set out in clause 9.

3. Absence of association with third parties

FM Season Hub is not affiliated with, associated with, authorised, endorsed or sponsored by Sports Interactive Limited, SEGA Publishing Europe Limited, or any companies connected with them.

"Football Manager" and related marks belong to their respective owners and are named solely to identify the Game with which the Program operates.

The names of clubs, competitions, players and other content displayed originate from the Game installation maintained by the User; no such content is distributed by the Operator.

Where an infringement of a third party's rights is identified, notice is to be given to fmseasonhub@gmail.com, identifying the material and the basis of the claim.

4. Capacity and minimum age

The Program is intended for persons aged 13 and over. A User aged between 13 and 18 must use it with the knowledge of their legal guardian.

Paid levels require a Patreon account, a platform which sets its own minimum age and capacity-to-contract rules.

5. Licence to use

Subject to these Terms, the Operator grants the User a personal, non-exclusive, non-transferable and revocable licence to install and use the Program and the Plugins, free of charge or paid according to the level contracted.

The User may not:

• redistribute, resell, rent, assign or publish the Program or the Plugins, in whole or in part;
• share the Access key with third parties;
• bypass, disable or interfere with the FM Season Hub Service, including the authenticity check of updates;
• decompile, disassemble or reverse engineer the Program, save where applicable law prohibits such a restriction;
• use the Program or the Plugins for any unlawful purpose.

The Program, the Plugins, their source code and their visual identity remain the property of the Operator, save for third-party components, which are governed by their own licences. These Terms effect no transfer of ownership.

6. Access levels and consideration

The Program comprises a free level and paid levels. Subscription to and charging for the paid levels are carried out by Patreon, and not by the Operator.

• Charging, renewal, cancellation and any refund are subject to that platform's rules and timeframes, and are to be dealt with there.
• Where support ceases, the User retains the free level, without erasure of data already stored on their device.
• Access keys are granted at the Operator's discretion, are personal, and operate on up to 2 (two) devices.

The limits of each level may be altered in future versions. An alteration of limits does not entail erasure of a season already stored, and is confined to preventing further storage above the prevailing cap.

7. Third-party services

Operation of the Program depends on third-party services: Patreon, as regards support levels, and Cloudflare, as regards hosting of the FM Season Hub Service and of the update files. The Installer further depends on the official website of the BepInEx project, from which it obtains that component when required.

Use of those features likewise subjects the User to those companies' terms and policies. The Operator exercises no control over them, over the availability of their services, or over changes they may introduce.

8. Assumption of risk by the User

The Program reads the memory of the Game's process while the Game is running, an operation necessary and inherent to its purpose.

The User acknowledges that:

• such use may conflict with the Game's own licence terms, the assessment of which rests with the User;
• programs that read memory may be flagged by antivirus solutions or anti-cheat systems, a circumstance beyond the Operator's control;
• Game updates may render the Program inoperative, temporarily or permanently.

The Program does not modify the Game or its save files, and is confined to reading. The Plugins are subject to their own regime, set out in clause 9.

9. Plugins

Installation of the Plugins is optional and depends on the User's express choice in the Installer, which indicates the Game installations into which they will be placed.

The User acknowledges that:

• unlike the Program, the Plugins alter how the Game works during matches, being loaded by BepInEx inside the Game itself;
• where the Game installation does not have BepInEx, the Installer obtains it and places it in the Game folder. BepInEx is a third-party component, distributed under the open-source licence that accompanies it, and remains in the Game folder for as long as other plugins depend on it;
• Game updates may render the Plugins inoperative or cause the Game to fail, until a compatible version is made available;
• the use of plugins may conflict with the Game's licence terms, the assessment of which rests with the User;
• the Plugins may incorporate third-party work, credited in their documentation.

The Plugins are used at the User's own risk. They may be removed at any time through the Program's uninstaller, which, where the User so chooses, removes the Plugins it installed without affecting those of other authors.

10. Automatic updates

When installed by the Installer, the Program checks, upon opening, whether a new version is available from the FM Season Hub Service and, if so, obtains and installs it automatically, then opens already updated. During use, the Program only signals that a new version exists, which is installed solely on the User's command.

Before any installation, the Program verifies the authenticity of the file obtained, by means of the Operator's digital signature and an integrity check, and rejects anything that fails verification.

Updates to the Program do not alter the Plugins or the data stored on the User's device. The Plugins are changed only when the User runs the Installer.

Acceptance of these Terms includes receipt of updates in the manner set out in this clause. A User who does not wish to receive them may stop using the Program, as provided in clause 16.

11. The User's data and files

The season database remains on the User's device and belongs to the User, who is responsible for making backups.

The Operator claims no rights whatsoever in the User's save data or in the seasons captured by the User, and receives no licence to use such data. That data is not transmitted to the Operator; the information actually transmitted is set out in the Privacy Policy.

Personal data processing is governed by the Privacy Policy, which forms part of these Terms for all purposes.

12. Availability

The Program operates on the User's device and remains functional in the absence of a connection, the last verified access level prevailing.

The FM Season Hub Service, including the distribution of updates, is provided on a best-efforts basis, without guarantee of availability, without response time and without any agreed service level, and may be suspended, altered or discontinued.

13. Exclusion of warranties

The Program and the Plugins are provided as is, without warranty of any kind, express or implied, including as to fitness for a particular purpose, accuracy of the values displayed, compatibility with versions of the Game, or continuity of operation.

The values displayed constitute an interpretation of the Game's memory and may contain inaccuracies; they should not serve as the sole basis for material decisions.

14. Limitation of liability

To the maximum extent permitted by applicable law, the Operator is not liable for indirect, incidental or special damages, nor for loss of profits, arising from the use of or inability to use the Program or the Plugins, including data loss, loss of save files, Game failures, or unavailability of the FM Season Hub Service.

No provision of these Terms excludes liability which the law does not permit to be excluded, including rights under Brazilian consumer protection law and any mandatory consumer rights in the User's own country. Certain jurisdictions do not permit particular limitations of liability; in such cases, the limitations set out here do not apply to the User.

15. Indemnity

The User undertakes to indemnify and hold the Operator harmless from claims, losses and expenses arising from use of the Program or the Plugins in breach of these Terms or of the law, in particular in cases of redistribution, sharing of the Access key, unlawful use, or infringement of third-party rights.

16. Term and termination

These Terms are of indefinite duration, taking effect upon acceptance.

The User may terminate them at any time by uninstalling the Program; the Plugins installed by the Installer are removed where the User so chooses in the uninstaller.

The Operator may terminate or suspend access in the event of breach of these Terms, in particular in cases of redistribution, sharing of the Access key, or attempts to bypass the FM Season Hub Service.

17. Amendments

These Terms may be amended. Where an amendment is made, the version stated in the preamble will change and the Program will request acceptance again on first execution following the update.

The documents form part of the installation package; a new version is received by installing a new version of the Program, including through automatic updates. Continued use of a version already installed entails the continued application, to that version, of the Terms accepted therein.

18. General provisions

• Severability. The invalidity of any provision of these Terms does not affect the remainder, which continues in full force.
• No waiver. Tolerance of a breach of any clause is a mere indulgence and does not constitute waiver or novation.
• Assignment. The User may not assign these Terms. The Operator may assign them upon succession of the project, on the same conditions.
• Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between the parties as to use of the Program and the Plugins.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil.

The courts of the User's domicile are designated for disputes arising from them where consumer legislation so permits; otherwise, the courts of the Operator's domicile.

PRIVACY POLICY

This Policy sets out the personal data processing operations carried out by FM Season Hub, the corresponding purposes and legal bases, the parties involved and the rights afforded to the data subject. It applies to the program installed on the user's computer, to its installer and to the remote service they consult.

1. Definitions

• Data subject — the natural person to whom the personal data processed relate.
• Processing — any operation carried out with personal data, as defined in art. 5, X of the LGPD and art. 4(2) of the GDPR.
• Controller — FM Season Hub, which determines the purposes and means of processing.
• Processor — a party carrying out processing on the Controller's behalf.
• Program — the FM Season Hub application installed on the data subject's device.
• Installer — the wizard that installs, updates and removes the Program and, where chosen by the data subject, the plugins for the game.
• FM Season Hub Service — the remote service operated by the Controller that confirms the access level, publishes notices and distributes the Program's updates.
• Device identifier — the cryptographic digest defined in clause 5.1.

2. Data not processed by the Controller

Data extracted from the data subject's game file — players, clubs, competitions, statistics, attributes and financial information — is not transmitted to the Controller or to any third party, and remains exclusively on the data subject's device.

The Program performs no collection of browsing data, telemetry, behavioural profiling or advertising. The data subject's operations within the Program are not recorded outside the device.

The Program and the Installer establish seven types of external connection, set out in clause 5: six with the FM Season Hub Service and one with the official website of the BepInEx project. No other communication with the network takes place.

3. Data stored on the data subject's device

The data subject's data is held in two directories on the device itself, under the data subject's exclusive control.

In the Program's data directory, %LOCALAPPDATA%\Programs\FM Season Hub\dados:

• the database of captured seasons, and working copies of it that are rebuilt automatically when deleted;
• the internal profile of the display component;
• copies of the latest responses from the FM Season Hub Service (notices, available version and names in the credits).

In the Documents\FM Season Hub directory:

• the preferences file, containing language, currency, list of favourites, access key where one exists, the device identifier defined in clause 5.1 and the record of acceptance of these documents (version accepted, date and language), given in the Program or in the Installer;
• the event log (fmsh.log), for diagnostic purposes;
• the filters, views and translations created by the data subject, and the reports of the diagnostic program;
• the update packages obtained as set out in clause 5.6, deleted after installation.

The Program's own files are installed in the %LOCALAPPDATA%\Programs\FM Season Hub directory and contain no personal data.

Deleting both data directories results in the complete erasure of the data held on the device.

4. Cookies and local storage

The Program uses no tracking, advertising or behavioural analytics cookies, and no third-party cookies.

The display component retains on the data subject's device only the data required to persist interface preferences:

• local storage — language, currency, selected columns, favourites and display preferences, retained until erased by the data subject;
• display component profile — window state, retained until erased by the data subject.

That data is neither transmitted to nor accessed by the Controller.

5. Data transmitted to the FM Season Hub Service

5.1 Device identifier

In order to prevent the unrestricted circulation of access keys, the Program computes a device identifier and transmits it to the FM Season Hub Service together with the key.

The identifier consists of a cryptographic digest (SHA-256) derived from the operating system installation identifier combined with the local user name. Only the digest is transmitted — a 32-character string from which neither the user name nor any other device data can be reconstructed.

Purpose: to allow the same access to be used on up to two devices and to prevent improper sharing.

5.2 Access key

The key entered by the data subject is transmitted for verification. The Program performs periodic automatic re-verification in order to establish whether the access remains valid. Where no connection is available, the last verified level prevails; access is not withdrawn by reason of network unavailability.

5.3 Authentication with Patreon

Where the data subject elects to authenticate with Patreon, that platform communicates to the Controller, upon express authorisation given in Patreon's own environment, the data subject's name and the active support levels.

The following are processed by the Controller: the data subject's name, the name of the support level, the corresponding level within the Program, and the refresh token enabling re-verification of support without further authentication.

The Controller has no access to payment, card or address data, which remains the responsibility of Patreon.

5.4 Notice board

The Program periodically retrieves the list of notices published by the Controller. That request carries no personal data of the data subject, and is limited to the Program version.

5.5 Supporter list shown in the credits

The Program periodically retrieves the list of names published in the credits, which is the subject of clause 8. That request carries no personal data of the data subject, and is limited to the Program version.

5.6 Checking for and obtaining updates

The Program asks the FM Season Hub Service whether a new version exists: upon opening and, during use, every 12 hours. Where a new version exists and the Program was installed by the Installer, the installation package is obtained from the same service and installed automatically, after the authenticity check described in clause 13.

Those requests carry no personal data of the data subject, and are limited to the Program version. The Controller keeps only the total count of packages obtained, with no link to the IP address, device identifier or any other data of the data subject.

5.7 Obtaining BepInEx through the Installer

Where the data subject chooses to install plugins into a game installation that lacks the BepInEx component, the Installer obtains it directly from the official website of the BepInEx project (builds.bepinex.dev) and verifies the integrity of the file before using it.

That request carries no personal data of the data subject and does not pass through the Controller, which neither receives nor records any information about it. As with any network communication, the originating IP address is visible to the party responsible for that website, under its own policy.

6. Data collected automatically by the FM Season Hub Service

The FM Season Hub Service is hosted on Cloudflare infrastructure. As a technical consequence of any network communication, the originating IP address is visible to that company and appears in its access logs.

The Controller uses the IP address for a single, determined purpose: to count invalid key attempts and to prevent bulk guessing. That record is erased automatically after 15 minutes. The IP address is not used in the requests covered by clauses 5.4 to 5.6.

7. Sharing with third parties

• Cloudflare, Inc. — hosts the FM Season Hub Service and the update files, and stores the records described in this Policy, acting as a Processor on the Controller's behalf.
• BepInEx project — maintains the website from which the Installer obtains BepInEx (clause 5.7). It receives no data of the data subject from the Controller.
• Patreon, Inc. — source of support data where the data subject authenticates. The scope of sharing is defined in the authorisation presented by that platform.
• Competent authorities — where a legal or regulatory obligation applies.

The Controller does not sell, assign or otherwise make available personal data to third parties for commercial or advertising purposes.

8. Publication of supporter names

The Program displays, on its About screen, the names of supporters on the tier whose description expressly provides for a mention in the credits.

• Data published — solely the nickname chosen by the data subject on Patreon and, where none has been set, the public name given there. No email address, pledge amount, join date or any other datum is published.
• Legal basis — performance of a contract at the data subject's request (LGPD art. 7, V; GDPR art. 6(1)(b)): the mention in the credits forms part of the consideration for the contracted tier, and is not presumed consent.
• Removal — a data subject who has ticked, on Patreon, the option to hide their own pledge is automatically excluded from the list. Removal may also be requested at any time through the channel in clause 16, taking effect within 6 (six) hours, the temporary storage period dealt with in clause 11.
• Scope — the list is public and accessible to any user of the Program.

9. International transfers

Cloudflare and Patreon are legal entities established outside Brazil, and the data described in this Policy is processed on servers abroad.

The transfer relies on the grounds set out in art. 33 of the LGPD and, where applicable, on the corresponding mechanisms in Chapter V of the GDPR.

10. Legal bases for processing

• Performance of a contract (LGPD art. 7, V; GDPR art. 6(1)(b)) — verification of the contracted access level, distribution of the Program's updates and publication of the name in the credits, where the contracted tier provides for it.
• Legitimate interests (LGPD art. 7, IX; GDPR art. 6(1)(f)) — prevention of improper key sharing and of bulk guessing.
• Consent (LGPD art. 7, I; GDPR art. 6(1)(a)) — authentication with Patreon.

The consent referred to in the last of these is optional and specific, given by the data subject in Patreon's environment and revocable at any time on that platform.

11. Retention periods

• Access record — level, name, refresh token and device identifiers: for as long as the access subsists. There is no automatic erasure deadline; records are erased upon the data subject's request or upon termination of the access.
• Name published in the credits: for as long as the support subsists on the corresponding tier. The temporary storage of the list is refreshed every 6 hours.
• Attempt counter per IP address: 15 minutes.
• Temporary Patreon authentication authorisation: 5 minutes.
• Total count of update packages obtained: indefinitely, as it contains no personal data.
• Data held on the device: until erased by the data subject; update packages, until the Program is next opened after their installation.

12. Rights of the data subject

Under art. 18 of the LGPD, the data subject is entitled to request at any time: confirmation that processing takes place; access to the data; correction of incomplete, inaccurate or outdated data; anonymisation, blocking or erasure of data that is unnecessary or processed unlawfully; portability; information as to sharing; and withdrawal of consent.

Data subjects established in the European Union are further entitled to object to and to restrict processing (GDPR arts. 18 and 21), and to lodge a complaint with the competent supervisory authority.

Requests are to be addressed to fmseasonhub@gmail.com. The response period is up to 15 (fifteen) days.

Independently of any request, the data subject has the following direct means available:

• signing out of the account within the Program, which removes the local link;
• deleting the Documents\FM Season Hub and %LOCALAPPDATA%\Programs\FM Season Hub\dados directories, which completely erases the data held on the device;
• uninstalling the Program, which removes its files and, where the data subject so chooses in the uninstaller itself, the plugins installed by the Installer, while keeping both data directories;
• revoking the authorisation granted to FM Season Hub in the Patreon account settings, which stops the sharing at source.

13. Security

Communications with the FM Season Hub Service take place over an encrypted channel (HTTPS). The access key and the device identifiers are held in storage restricted to the service, and the device identifier subsists solely in the form of a cryptographic digest.

Update packages are accompanied by the Controller's digital signature. The Program verifies the signature and the integrity of each package before installing it, and rejects anything that fails verification.

No system is entirely secure. Should a security incident occur that may give rise to relevant risk or harm to the data subject, the Controller will notify the data subject and the competent authority as required by art. 48 of the LGPD and arts. 33 and 34 of the GDPR.

14. Children

The Program is not intended for children under 13, and no data of that age group is knowingly collected. Paid features require a Patreon account, a platform which sets its own minimum age rules.

15. Amendments to this Policy

Where this Policy is amended, the version stated in the preamble will change and the Program will request acceptance again on first execution following the update.

The documents form part of the installation package; a new version is received by installing a new version of the Program, including through automatic updates.

16. Data protection officer and contact

No data protection officer has been formally appointed. The functions set out in art. 41, § 2 of the LGPD are performed directly by the Controller, through fmseasonhub@gmail.com.

17. Entry into force

This Policy takes effect on the date stated in the preamble and remains in force until replaced by a subsequent version.
